II.3.3.1. General provisions

Article 14 of Appendix II of the Convention

Customs authorities may authorize a person, who shall be called an "authorized issuer," to issue the following means of proof of Union status:

    1. T2L and T2LF documents without visa (see section II.3.3.2) (temporary):
      a) with prior authentication by customs;
      b) with authentication by the authorized issuer itself;
      c) with electronic authentication by the authorized issuer itself without signature;
    2. customs manifest of goods without visa or registration (see section II.3.3.3);
    3. shipping company manifests without endorsement (see section II.3.3.4) (transitional provision):
      a) shipping company manifest as evidence;
      b) shipping company manifest after departure;
    4. invoices or transport documents for goods valued at more than 15 000 euros without endorsement (transitional provision) (see section II.3.3.2).

Please note that the authorization to issue T2L/T2LF documents without a visa is a transitional provision insofar as the evidence will consist of T2L/T2LF documents rather than data entered into the PoUS system.
Authorization to issue certain means of proof of Union status without visa (and registration) by customs is a customs decision subject to application. This means that the general rules for customs decisions described in Part VI will apply, unless otherwise specified.
The procedure to be followed shall be as provided in Part VI, Section 2.2, unless additional information is provided below.
The application shall be submitted to the customs authority responsible for the location where the applicant's main customs accounts are located or accessible and where at least part of the activities covered by the authorization are carried out.
The applicant must meet the general and specific conditions. The general conditions that apply in all circumstances are listed in the table below. Other specific conditions are considered in the sections relating to each specific means or mechanism.

  • the applicant is established in the EU or in a common transit country;
  • If established in the EU, the applicant must have an Economic Operator Registration and Identification Number (EORI);
  • the interested party has not committed serious or repeated infringements prohibited by customs or tax legislation;
  • The competent customs authorities may supervise the procedure and carry out controls without having to make an administrative effort disproportionate to the needs of the person concerned;
  • The interested party has records that allow the competent authorities to carry out effective control.
