II.3.3.2.1. Authorization

In addition to the general conditions listed in Section II.3.3.1, the applicant must meet the following specific conditions in order to obtain authorisation to issue T2L/T2LF documents, invoices or transport documents as proof of Union status without customs endorsement.

Specific conditions for the issuance of T2L/T2LF documents, invoices or transport documents

Article 128, sections 2 and 4, of the AD
Article 14 of Appendix II of the Convention

  • The person concerned regularly issues proof of the customs status of Union goods or the customs authorities know that they can comply with the legal obligations for the use of such means of proof.

In addition to the general conditions listed in section II.3.3.1 and the specific conditions, the applicant must meet the following specific conditions in order to be authorised to issue electronic T2L/T2LF documents authenticated by the issuer itself as proof of Union status without customs endorsement.

Specific conditions applicable to electronic authentication by the authorized issuer itself without signature

Article 17 of Appendix II of the Convention

  • The authorized issuer has given a written commitment in which it assumes responsibility for the legal consequences arising from all T2L/T2LF documents or commercial documents issued with the special seal.

CUSTOMS

In particular, the authorization must specify:
a) the customs office assigned the responsibility for pre-authenticating the "T2L" or "T2LF" forms;
b) the manner in which the authorized issuer will determine the correct use of the forms;
c) the categories or movements of goods excluded;
(d) the period and manner in which the authorized issuer must inform the competent customs office so that it can, where appropriate, inspect the goods before their departure;
e) whether the evidence must:

1) be previously authenticated by customs;
2) be authenticated by the authorized issuer himself with signature;
3) be electronically authenticated by the authorized issuer itself (without signature);

(f) the authorized consignor must complete and sign the form before the goods are dispatched;
g) if the customs authority allows the use of loading lists that do not meet all the requirements.
