II.3.3.4.2. Completion of the test

Such manifest must be authenticated before the vessel's departure at the port of departure by the shipping company.

However, for logistical reasons, sometimes the manifest is not available at the time of the vessel's departure, and therefore its authentication cannot take place at that time. In that case, a shipping company can electronically send the manifest details from the port of departure, after the vessel's departure to the port of destination, so that the manifest is available at the port of destination before the vessel's arrival.

Pursuant to Articles 128 quater and 128 quinquies of the Convention on International Trade in Endangered Species (Article 18 of Appendix II to the Convention), the issuance of such a manifest retroactively to prove the status of the goods is permitted, and, subject to certain conditions, the transmission of such manifest to the port of destination through an electronic data interchange system.

When the shipping company's manifest is used as proof of the customs status of Union goods, it must include at least the following information:

  • the name and full address of the shipping company;
  • the name of the vessel;
  • the place and date of loading of the goods;
  • the place of unloading;
  • and for each shipment:
    • the reference of the bill of lading or any other commercial document;
    • the number, nature, brands and numbering of the packages;
    • the description of the goods according to their usual commercial name, containing all the necessary information for their identification;
    • gross mass in kilograms;
    • where applicable, the identification numbers of the containers; as well as
    • the following indications regarding the status of the goods:
      • the code "C" (equivalent to "T2L") for goods whose customs status as Union goods can be proven; or
      • the code "F" (equivalent to "T2LF") for goods originating in or transported between territories excluded from the fiscal territory of the Union, the customs status of which can be established as Union goods; or
      • code "N" for other goods.
