III.2.1.2. Non-compliances
Article 30 of Appendix I to the Convention
If the transit declaration does not provide information on the guarantee, or if, in the case of a business continuity procedure, the required guarantee document is not presented at the customs office of departure, the declaration must not be accepted.
Article 89, paragraph 2, Article 94, paragraph 3, and Article 95 of the UCC
If the amount of the guarantee is insufficient, the customs office of departure must not release the goods for transit unless an additional guarantee is provided to cover the full amount of the (customs) debt that may arise.
The customs office of departure must also refuse release when, in the case of a business continuity procedure, the documents submitted demonstrate that the guarantee has not been issued to the holder of the transit operation regime.
