III.4.1.8.2. Exception to the decision temporarily prohibiting the use of the comprehensive guarantee or the comprehensive guarantee with a reduced amount

(including dispensation)

Despite the decision on the temporary prohibition of the use of the comprehensive guarantee or the comprehensive guarantee with a reduced amount (including a guarantee waiver), the use of such a guarantee may be authorized if the holder of the scheme meets the following criteria:

  • can prove that no (customs) debt has been incurred in respect of the goods in question during the common/Union transit operation carried out in the two years preceding the decision on the ban; or if, despite the (customs) debt having arisen during said period, he can prove that said debts have been paid in full by the debtor(s) or by the guarantor within the established period;
  • demonstrates a high level of control over its operations and the flow of goods through a commercial and transport records management system that enables appropriate customs controls;
  • Its financial solvency is considered proven by enjoying a good financial situation that allows it to meet its commitments, taking due account of the characteristics of the type of activity in question.

These exceptional uses of the global guarantee concern both common and Union transit operations.

In the case of a business continuity procedure, the following must be indicated in box 8 of the TC31 Guarantee Certificate: «UNLIMITED USE – 99209». All language versions of this statement are included in Annex B6 of Appendix III to the Convention/Appendix D1 of Annex 9 to the ADT.
