IV.1.4.2.4. Transit Declaration - Security

Before goods arrive in the customs territory of the Union, an entry summary declaration (ESD) must be lodged at the customs office of first entry.

Customs then ensures that, based on this declaration, a risk assessment of the operation is carried out, evaluating the data in light of the risk criteria.

The deadlines for submitting the DSE are directly related to the mode of transport and are as follows:

  1. road transport: at the latest one hour before arrival;

  2. railway:
    • when the rail journey from the last railway station located in a third country to the customs office of first entry takes less than two hours: one hour before arrival at the latest;
    • in all other cases: no later than two hours before arrival.

  3. inland waterways: no later than two hours before arrival;

  4. containerized sea cargo: at the latest twenty-four hours before loading at the port of departure;

  5. bulk/containerized bulk sea cargo: no later than four hours before arrival;

  6. in the case of goods originating from:

    • Greenland,
    • the Faroe Islands,
    • Iceland,
    • ports on the Baltic Sea, the North Sea, the Black Sea and the Mediterranean Sea;
    • all ports in Morocco: no later than two hours before arrival;
  7. For the movement of goods between a territory located outside the customs territory of the Union and the French overseas departments, the Azores, Madeira or the Canary Islands, where the journey time is less than 24 hours: no later than two hours before arrival;

  8. For air transport, the deadlines are as follows:

    • For flights of less than four hours duration: at the latest at the time of the actual departure of the aircraft;
    • for other flights: no later than four hours before arrival.

The DSE will not be necessary:

  1. with respect to the goods listed in Article 104 of the AD;
  2. if there are international agreements between the Union and third countries providing for the recognition of safety and security controls carried out in those countries as countries of export in accordance with Article 127(2)(b) of the UCC. This affects the following countries: Norway, Switzerland, Liechtenstein, Andorra and San Marino.

The DSE shall be submitted by the carrier or, regardless of the carrier's obligation, by the following persons:

  1. the importer or consignee or any other person in whose name or on whose behalf the carrier acts; or
  2. any person who is in a position to present or arrange for the presentation of the goods in question to the customs office of entry.

The DSE will be submitted electronically using the Import Control System.

Alternatively, the NCTS may be used provided that:

  1. a transit procedure is initiated at the external border of the Union upon entry;
  2. the data includes the information requested for a specific DSE.

In this case, the transit/security declaration (IE015) with the transit and security and protection details must be submitted to the customs office of entry—which is also the customs office of departure. After the risk assessment and release of the goods for transit, the DATS and LdATS will be printed. The DATS and LdATS models are provided in Appendices G1 and G2 of Annex 9 of the ADT.

All references to the DAT and the LdA also apply to the DATS and the LdATS.
