Articles 273 and 276 of the AE
The "holder" (TIR Carnet holder) is the person who has been granted an authorization to carry out his or her activities under the TIR arrangements and in whose name the TIR Carnet is presented. The TIR Carnet holder is responsible for presenting the vehicle and goods, along with the TIR Carnet, at the customs offices of departure, transit, and destination. Within the customs territory of the Union, the TIR Carnet holder is also responsible for submitting the TIR Carnet information for the TIR operation to the customs office(s) of destination or exit.
Article 6, paragraph 4, and Annex 9, Part II, of the TIR Convention
The legal concept of "holder" (TIR Carnet holder) in the TIR Convention makes the granting of authorization to benefit from the TIR regime subject to compliance with a series of minimum conditions and requirements.
