IX.2.2.2.2. Authorization control

Explanatory Notes 9.II.4 and 9.II.5 of the TIR Convention

Given the essential role played by the TIR Carnet holder in the TIR regime, particularly as a declarant, it is important to keep the list of TIR Carnet holders in the International TIR Database (ITDB) up to date. The competent authorities must promptly communicate to the TIR Executive Board (TIRExB) updated information on the situation of authorized TIR Carnet holders. The competent customs authorities must enter information on authorizations and revocations of authorizations for the use of TIR Carnets directly into the ITDB.

Annex 9, Part II, paragraphs 4 and 5, of the TIR Convention

This requires ongoing monitoring of authorizations to assess whether the TIR Carnet holder is still eligible for the authorization and to ensure that the conditions and requirements to which it is subject remain appropriate and necessary.

On the other hand, it is recommended that unused authorizations be cancelled if it is observed that no TIR Carnets have been issued to the TIR Carnet holder over a period of time (for example, one year). The competent authorities must record the end of the activity without delay in the ITDB.

Monitoring of the authorization must be carried out jointly with the guarantor association. If such monitoring reveals evidence of non-compliance with the authorization, the competent authorities may consider revoking it.

In addition, the guaranteeing associations will cooperate with the competent customs authorities and request modifications (updating information regarding authorized TIR Carnet holders) through the ITDB. Such applications will be validated by the competent customs authorities.
