Article 26, paragraph 2, of the TIR Convention

The suspension of a TIR transport, even if temporary, means the cancellation of the TIR guarantee for the suspended portion of the journey. A TIR transport must be suspended if it is carried out in a Party not contracting to the TIR Convention. Where part of a TIR transport journey is not carried out by road (for example, a sea journey involving a simpler transit procedure or no procedure at all), the TIR Carnet holder may request the customs authorities to suspend the TIR transport for that part of the journey and reinstate it upon completion.

Article 26, paragraph 3, of the TIR Convention

In such cases, the respective exit and entry customs controls and procedures will be carried out. See sections IX.4.4 and IX.5.3.

Comments on Articles 2 and 26 of the TIR Convention

However, within the territory of a Contracting Party, the TIR procedure may be applied to a section of the journey not carried out by road (for example, by rail) where the customs authorities are capable of ensuring the execution of the controls and formalities necessary to ensure a correct start and completion of the procedure at the customs offices of entry and exit (and destination, where applicable).
