V.4.3.2. Presentation of a guarantee

A guarantee is required to initiate a transit regime (except in cases of exemption provided for by law or by authorization).

More detailed information on warranties is provided in Part III.

CUSTOMS
The customs office of departure will check that:

  • The warranty data indicated in box 52 of the SAD or DAT match those in the warranty documents presented;
  • the amount of the guarantee is sufficient;
  • The guarantee is valid in all Contracting Parties involved in the transit operation;
  • The guarantee is presented on behalf of the holder of the regime designated in box 50 of the SAD or DAT;
  • the warranty has not expired (TC31 and TC33 certificates are still valid);
  • the validity period of one year from the date of issue has not expired (validity of the TC32 title);
  • The signature on the declaration in box 50 of the SAD or DAT matches the signature on the back of the comprehensive guarantee certificate TC31 or the guarantee exemption certificate TC33.

The original warranty documents must be presented.

In the case of an individual guarantee in the form of securities, the TC32 guarantee title shall be kept and attached to copy No. 1 of the SAD or to a first copy of the DAT.

In the case of an individual guarantee in the form of a commitment, this shall be kept and attached to copy No. 1 of the SAD or to a first copy of the DAT.

In the case of a comprehensive guarantee or a guarantee waiver, the original guarantee certificate (TC31 or TC33) will be returned to the declarant.
