V.4.3.8. Deadline for submission of goods

Article 34 and Article 45, paragraph 2, of Appendix 1 to the Convention

The customs office of departure will set a deadline for presenting the goods at the customs office of destination.

Article 297 and Article 306, paragraph 3, of the AE

This period prescribed by said customs office shall be binding on the competent authorities of the countries whose territory the goods enter during a transit operation. This deadline cannot be modified by the authorities of the countries in question.

If the goods are presented at the customs office of destination after the deadline set by the customs office of departure, the holder of the procedure shall be deemed to have complied with the deadline when the holder or the carrier demonstrates to the satisfaction of the customs office of destination that he is not responsible for the delay.

CUSTOMS
When setting the deadline, the customs office of departure shall take into account:

  • the means of transport to be used;
  • the itinerary;
  • transport or other legislation that may affect the setting of a deadline (for example: social or environmental legislation affecting the mode of transport, transport regulations on working hours and mandatory rest periods for drivers);
  • the information communicated by the holder of the regime, where applicable.

The customs office of departure will indicate the deadline in box D (/J) of the SAD or DAT (following the DD-MM-YY system) and, if it agrees with the deadline indicated by the holder of the regime, will endorse it. The corresponding date will be the day on which the goods, the transit declaration and any accompanying documents must be presented at the destination customs office.
