VII.3.2.2. General procedure for requesting information from the regime holder

The holder of the regime must be informed when:

Article 49, paragraphs 2, 3, 4, 5 and 6 of Appendix I to the Convention
Article 310, sections 2, 3, 4, 5 and 6, of the AE

  • the deadline for presenting the goods at the customs office of destination has expired (the IE006 message has not been received from the country of destination); and
  • Messages IE904 and IE905 have been sent and the status of the shipment is identical or equivalent at both customs offices; and
  • The information contained in box 8 of a transit declaration is considered insufficient to initiate the investigation procedure with the declared customs office of destination; or
  • at the latest within 28 days after sending the "Investigation Request" message (IE142) if there is no reply from the requested customs office of destination or if it has given a negative reply by means of the "Response to Investigation Request" message (IE143) using codes 1 or 2 (see section VII.3.4.4). The competent authorities at the place of departure send the message "Claim for a non-arrival of a consignment" (IE140) to the holder of the procedure, who responds with the message "Information on a non-arrival of a consignment" (IE141) within 28 days.

If the information provided by the procedure holder is not considered sufficient to complete the procedure, but is sufficient to continue the investigation procedure, the competent authority of the country of departure shall send the IE142 message to the customs office of destination or continue the investigation procedure with the customs office of destination to which the IE142 message has already been sent, using the "Investigation and Recovery Information" (IE144) message to inform it that additional information is available.

Note: if the holder of the regime:

  • does not communicate any information within twenty-eight days; or
  • the information provided justifies a collection; or
  • The information provided is considered insufficient to initiate the investigation procedure with the customs office of destination;

The recovery procedure shall be initiated one month after the expiry of the twenty-eight-day period (see section VII.3.4.5 if the investigation procedure has been initiated with the customs office of destination).

ECONOMIC OPERATORS

Depending on the method used by the competent authorities at the customs office of departure, the holder of the procedure will be required to provide information with the E141 message within 28 days.
