VII.3.2.3. Procedure for requesting information in the case of simplified procedures specific to certain modes of transport

The head of the regime will be informed:

Article 108 of Appendix I to the Convention
Articles 46, 48, 49 and 51 of the ADT

  • Yes, when using the common/Union transit procedure on paper for goods transported by air and the Union transit procedure on paper for goods transported by sea:
    • The monthly list of manifests has not been sent to the competent authority of the airport or port of departure within two months from the end of the month in which the manifests were submitted to the customs office of departure; or
    • This list does not include all suitable manifests (since the scheme cannot be considered finalised with regard to manifests not listed therein).
  • Yes, when using an electronic transport document (ETD) as a transit declaration for the common/Union transit procedure for goods transported by air and an electronic transport document (ETD) as a transit declaration for the Union transit procedure for goods transported by sea:
    • an audit of the airline or shipping company's manifests or records; or
    • A notification of a violation or irregularity by the authorities of the airport or port of destination reveals that the DTE is not available or has not been presented at destination.

The model letter given in Annex VII.8.2 may be used for this purpose.

It is not mandatory to use this model, although it contains the minimum necessary data.

If the scheme holder contacts the competent authorities electronically, the letter and the response to it may be replaced by equivalent electronic messages.

However, the request for information will not be necessary when the holder of the scheme itself (the airline, shipping or railway company or the transport company) discovers and notifies that the scheme has not been terminated in accordance with its obligations under the specific simplified procedure corresponding to the mode of transport in question.

When the holder of the scheme contacts the competent authorities electronically, this notification may be replaced by an equivalent electronic message.
