VIII.2.4.5.2. Limited liability of the guarantor
Section 2 of the surety document Annex C4 of Appendix II of the Convention
Annex 32-03 of the AD
In the case of a global guarantee, if successive payment requests are made, the guarantor may limit his liability to the maximum amount he has specified. However, this limit will only apply to transit operations that begin within thirty days of receiving the previous payment request. This is due to the need to keep the financial risks assumed by the guarantor within acceptable limits. However, this means that the coverage of a guarantee may be insufficient for transactions beginning in the month following a payment request.
Example:
The surety bond sets a maximum amount of 50,000 euros. On January 15, the guarantor receives an initial payment request for €40,000 and pays the amount.
The guarantor may limit his liability to the balance of 10,000 euros for any transit operation initiated before February 14. It is irrelevant whether this transaction began before or after January 15 or the date on which you received the payment request.
Article 2 of Appendix I to the Convention
Article 151 of the AE
Article 82 of the AD
However, the guarantor is again obliged to pay the requested amount, up to a maximum of €50,000, if they receive a second payment request for a transit transaction initiated on or after February 14. However, the guarantor may terminate his guarantee commitment at any time, and the termination will become effective on the sixteenth day following notification to the customs office of the guarantee.
