Preliminary measures are a legal instrument to ensure the collection of debts, when there are reasonable indications that, otherwise, the collection would be frustrated or seriously hindered, and must, in any case, be proportional to the damage that is intended to be avoided.
If a notification of precautionary measures regarding an asset has been received, objections may be submitted, without prejudice to the appeal that may be filed once the measure has been adopted and notified. By paying the precautionary measures, guaranteeing the amount sought or offering another substitute asset, the lifting of the same may be obtained.
A precautionary measure may be converted into a definitive embargo or into a judicial precautionary measure.
