4.2.5 Codes 01514 and 00272 adjustments for income derived from operations with withdrawal or hold (Art. 11.13 LIS)

Article 11.13 of LIS establishes that the income corresponding to the accounting record of write-offs and waits as a result of the application of Law 22/2003, of July 9, Bankruptcy, will be charged to the tax base of the debtor as it is appropriate to subsequently record financial expenses derived from the same debt and up to the limit of the aforementioned income.

In accordance with the provisions of this provision, in the event that the amount of income is greater than the total amount of financial expenses pending to be recorded, derived from the same debt, the imputation of the former in the tax base will be carried out proportionally to the financial expenses. recorded in each tax period, with respect to the total financial expenses pending to be recorded derived from the same debt.

In this way, the income recorded and provided that there is no financial expense, will generate the corresponding negative tax adjustment, which must be declared for said amount in box [00272] of decreases.

Subsequently, as the corresponding financial expenses are incurred, these amounts will be considered tax income, and those amounts must be declared in box [01514] for increases, with the corresponding positive tax adjustment.
