Changes in the degree of disability will affect the calculation of the average number of disabled workers.

Disabled workers who, as a result of their leave of absence, must be deregistered from the corresponding Social Security Regime, will not be included in the average workforce calculation for the purposes of the provisions of article 38 of the LIS , unless it is a leave of absence situation that is similar to being discharged.

For the calculation of the average workforce, both full-time and part-time workers with disabilities will be taken into account, provided that they are people employed under the terms provided by labour legislation, taking into account the hours contracted in relation to the whole day.
