5.84. Video surveillance
Description of the activity
Recording and processing of images for the internal and external security of people who access and transit through the Tax Agency buildings.
Purpose
To guarantee the safety of people, goods and facilities.
Legitimation
Article 6.1.e of EU Regulation 2016/679 establishes that personal data may be processed when “the processing is necessary for the fulfillment of a mission carried out in the public interest…” . In this way, the purpose of video surveillance is to guarantee the security of people, property and facilities; the public interest legitimizes such treatment.
The video surveillance systems installed in the Tax Agency buildings are controlled by private security personnel. This is based on what is established in article 42. “Video Surveillance Services” of Law 5/2014, on Private Security, which establishes:
"1. Video surveillance services consist of the exercise of surveillance through camera or video camera systems, fixed or mobile, capable of capturing and recording images and sounds, including any technical means or system that allows the same treatments as these.
When the purpose of these services is to prevent infractions and avoid damage to people or property subject to protection or prevent unauthorized access, they will necessarily be provided by security guards or, where appropriate, by rural guards.”
