Royal Decree-Law 7/2024, of November 11, was published in the Official State Gazette of November 12, adopting urgent measures to promote the Immediate Response, Reconstruction and Relaunch Plan against the damage caused by the Isolated Depression at High Levels (DANA) in different municipalities between October 28 and November 4, 2024.

Among the fiscal measures agreed in this Royal Decree-Law, the following stand out:

• In the Personal Income Tax, a 25% reduction in the net income of modules applicable in favor of persons who develop their economic activity in the objective estimation method is approved, with its subsequent transfer to the calculation of the fractional payments corresponding to the last quarter of 2024.

• A 25% reduction in the rate accrued for current operations is also approved for persons who carry out their economic activity under the simplified VAT regime.

• These taxpayers are allowed to exceptionally waive the application of the module system in 2024, paying taxes in this case under the simplified direct assessment system, without this decision preventing the taxpayer from applying the module system again in 2025 or 2026.

• The extraordinary waiver of the objective estimation method for 2024 may be made during the month of December 2024 or by submitting within the regulatory period the declaration corresponding to the fractional payment of the fourth quarter of 2024 in the manner provided for the direct estimation method.

• The number of beneficiaries of direct aid to companies and self-employed persons, contemplated in Royal Decree-Law 6/2024, is extended not only to those who had their tax domicile in the municipalities affected by the DANA, but also to those companies or self-employed persons who have establishments or operations in the affected municipalities, even if they did not have their tax domicile in those localities.

• The exemption from the IBI of a rustic nature corresponding to the year 2024 is approved for farms, work premises and similar, of a rustic nature, owned by farmers and ranchers who have suffered losses in production.
