III.1.3. Warranty waiver

Article 13 of Appendix I to the Convention

Exceptionally, there is no need to provide a guarantee in the following cases:

  • Disclaimer of warranty by law:

Article 89, sections 7, 8 and 9, of the CAU
Article 24, paragraph 2, of the ADT

  • goods transported by the Rhine, the Rhine waterways, the Danube or the Danube waterways;
  • goods transported by fixed transport facilities;
  • goods placed under the common/Union transit procedure using the DTE simplification for air and sea transport (the latter being the exclusive responsibility of the Union transit procedure);
  • in the Union: where the amount of import duties does not exceed the statistical threshold value for declarations established pursuant to Article 3(4) of Regulation (EC) No 471/2009 on Community statistics relating to external trade with third countries (OJ L 152, 16.6.2009, p. 23);
  • in the Union: countries, regional and local public authorities or other bodies governed by public law with respect to the activities in which they participate as public authorities.

The navigable waterways of the Rhine are defined in the list in Annex III.7.2. The information has been provided by the customs administrations of the countries concerned.

  • Waiver of the guarantee by national decision applicable only to common transit countries:

Article 10, paragraph 2, letter a) of the Convention

  • on the basis of a bilateral or multilateral agreement of the Contracting Parties for operations covering only their territories;

Article 10, paragraph 2, letter b) of the Convention

  • for the part of an operation between the customs office of departure and the first customs office of passage, in accordance with a decision of the Contracting Party concerned.
