III.1.4. Validity zone

In general, the guarantee will only be valid for the Contracting Parties participating in the common/Union transit operation. Exceptionally, individual guarantees in the form of cash deposits or securities shall be valid for all Contracting Parties.

In cases where the guarantee is valid only for the Contracting Parties involved, a restriction on the area of validity may be possible. The guarantor may delete, in the guarantor's commitment, the name of the Contracting Party or Parties or of Andorra or San Marino. As a result of this deletion, the guarantee will be valid in all Contracting Parties and States that have not been crossed out. However, the guarantees do not cover common transit operations originating in and ending in Andorra or San Marino, where the Convention does not apply.

Under the EU transit system, the guarantee will be valid in all Member States, as well as in Andorra and San Marino. Provided that neither the EU nor Andorra or San Marino have been crossed out in the guarantor's commitment and that the conditions for the use of the guarantee are respected by the holder of the procedure, the holder of the procedure may provide a guarantee accepted or constituted by the competent authorities of a Contracting Party other than the EU for a Union transit operation within the Union or between the Union and one of the aforementioned States.
