VIII.1. Scope of the provisions

This chapter deals with the scope of the provisions on debt and debt collection under the common transit and Union regimes.

The purpose of Part VIII is to establish a harmonized version of the situations giving rise to debt within the strict scope of common transit or Union operations, to identify debtors and to unequivocally determine the countries competent to collect a debt from debtors and guarantors. However, the provisions are limited to these aspects and leave the individual Contracting Parties to the Convention responsible for effective collection in accordance with their national legislation, except for the time limits for initiating collection. For EU purposes, harmonized rules on customs debt are set out in the Union Customs Code.
