VIII.3.1. General analysis

The legal basis governing the jurisdiction to carry out the recovery procedure is based on the principle that responsibility rests with the competent authority of the country of origin and that it plays a key role in initiating the procedure, in finding the country with jurisdiction for these tasks, or, where appropriate, in accepting a request for the transfer of jurisdiction.
