Bids
Only those registered users who have constituted the deposit established by the Managing Authority can bid in an auction, in the auctions that require it.
At the time of participating in an auction by making the first bid, the Portal will ask you to indicate whether you are going to do so in your own name (the registered natural person), on a community basis or on behalf of a third party. Successive bids will be deemed to have been made with the same characteristics as the first bid.
No. Bids that have been confirmed on the Auction Portal cannot be withdrawn or modified. Therefore, it is essential that before confirming a bid, you carefully review the data of the bid you are going to confirm.
If during the bidding process you indicate that you want to reserve your bid, your deposit will be withheld at the conclusion of the auction's bidding period, even if your maximum bid has been exceeded by another bidder, until the auction awarded and finalized by the Managing Authority. In the event that the bidders with the highest bids are not finally awarded, the Auction Managing Authority will appoint as the new winner the second or subsequent highest bidder who had requested the reservation of their bid.
The Portal will ask the bidder only once if they wish to reserve their maximum bid. It will be at the time of the bidder's first bid in the auction. Once you place a bid indicating that you wish to make a reserve, all subsequent bids in the same auction will be made with a bid reserve. Likewise, once you place a bid indicating that you do NOT wish to make a reservation, all subsequent bids in the same auction will be made without a bid reservation.
If you wish to place a bid for a value less than or equal to the maximum bid, the system will only allow it if you also accept a reservation of your bid until the auction is awarded, since you can only become the final winner if the bidders with the highest bids renounce the award.
The Auction Portal will send you the following information notices regarding the evolution of the auction:
- If you are currently the highest bidder, you will be sent a notice the first time your bid is outbid by another bidder. If said bid is exceeded again, the notice will only be sent to the new highest bidder at that time.
- If you have participated in the auction in any way (by depositing, bidding, or both), you will be sent a notice of the end of the bidding period. Additionally, if you have placed bids with a bid reservation, the certificate of your best bid will be sent to you at the conclusion of the auction.
- If you have requested this on the Portal through your searches, you will be sent a notice with the start of the bidding period for the corresponding auctions.
Participation in an auction has two different parts that must be carried out by the same user of the Auction Portal.
- Constitution of the deposit . You can make the deposit with the bank account you want as long as you meet these conditions:
- Belong to one of the AEAT collaborating entities.
- That the user who performs the operation on the Portal (you in this case) is either the owner of the account or a proxy representative on the account (if the owner is a company).
- Do not need a joint signature, if you have more than one owner
- Placing the bid . In one of the steps of placing the bid, the Portal will ask you to indicate your form of action, that is, on behalf of whom you are acting. At that time, you must indicate that you are acting in whole or in part on behalf of a third party. The Portal will ask you for the information of the third party you are representing, which will be in whose name the bid will be made and who will be awarded the property, if you are the winner.
You can identify yourself on the Portal using your representative certificate or a personal certificate, but regardless of how you have identified yourself on the Portal, to place a bid on behalf of a company, you must always indicate this at the time of placing the bid, when the Portal ask you for information about your form of action (personal, joint venture or on behalf of third parties). For the bid certificate to be issued in the name of the company, it is essential that you indicate at that time that you are acting on behalf of a third party (in this case the company). If you do not make this indication, the bid certificate will be issued only in your name and not in the name of the company.
