4.7. Right to data portability

According to article 20 of EU Regulation 2016/679 .

“Right of portability

  1. The interested party will have the right to receive the personal data that concerns him/her, which he/she has provided to a data controller, in a structured, commonly used and machine-readable format, and to transmit them to another data controller without being prevented by the data controller to whom it is communicated. had provided them, when: When exercising their right to data portability in accordance with section 1, the interested party will have the right to have personal data transmitted directly from controller to controller when technically possible.
    1. the processing is based on consent pursuant to Article 6(1)(a) or Article 9(2)(a) or on a contract pursuant to Article 6(1)(b) and
    2. The processing is automated.
  2. When exercising his or her right to data portability in accordance with paragraph 1, the data subject shall have the right to have personal data transmitted directly from controller to controller where technically feasible.
  3. The exercise of the right mentioned in section 1 of this article will be understood without prejudice to article 17. This right will not apply to processing required to fulfil a public interest purpose or in the exercise of public powers granted to the controller.
  4. The right mentioned in paragraph 1 shall not adversely affect the rights and freedoms of others.”
