To what values do I have to apply the tax rates?
Find out the values you must declare depending on whether the means of transport is new or used, which will serve as the basis for applying tax rates.
New means of transport:
In this case, you must take the amount which, on the acquisition of the means of transport, has been determined as the taxable amount for Value Added Tax purposes, of an equivalent tax or, in the absence of both, by the total amount of the consideration paid by the purchaser, determined in accordance with Article 78 of the Law on Value Added Tax. In the latter case, the Canary Islands General Indirect Tax paid or borne directly by the seller of the means of transport shall not form part of the taxable base.
Used means of transport
In this case, you must take the market value at the date of accrual of the tax.
If they have previously been registered abroad and are subject to their first definitive registration in Spain as used vehicles, the market value shall be reduced, to the extent that it is included therein, by the residual amount of the indirect taxes that would have been payable, without being deductible, if the means of transport had been subject to their first definitive registration in Spain as new.
You can also use the average sales prices approved for this purpose by the Ministry of Economy and Finance that were in force on the date of accrual of the tax to determine the market value. If you use this value, the tax authorities will not check it by the other means provided for in Article 57 of the General Tax Law.
