Updates on the measures regarding the Control of Trade in Fluorinated Gases: new certificates created and more

In relation to the Regulation (EU) 2024/573 on fluorinated greenhouse gases has seen various updates and corrections to the integration of imports and exports (see measures 724 and 765). The start date is 6/25/2025.

Among other:

  • Two new TARIC document codes Y169 and Y179 have been created.

    • Y179: The quota provisions of Article 19 (Reg 2024/573) do not apply to products or appliances pre-charged with fluorinated greenhouse gases other than HFCs in Section 1 of Annex I (Reg 2024/573).

      Use: Y179 is integrated into the "Quota" condition pairs for cases where products and equipment may contain and operate with fluorinated gases other than those in Annex I and are therefore not subject to the quota provisions in accordance with Article 19 of the F-Gas Regulation.

    • Y169: Products and equipment, including parts (excluding military and repair exemptions) listed in Annex IV containing fluorinated gases or based on fluorinated gases not subject to the prohibition imposed by Article 11.1. (Reg 2024/573).

      Use: Y169 is included in the "Prohibitions" group of conditions and applies to products and equipment, including parts, containing fluorinated gases or whose operation depends on them, which are not listed in Annex IV of the Regulation, or if listed, the prohibition has not yet entered into force. In both cases, although not prohibited, they are covered by other provisions of the RGF, since they contain fluorinated gases or operate with fluorinated gases from the RGF.

      With this new update and the introduction of TARIC document codes Y169 and Y179 in the TARIC integration, the current TARIC document code Y160 must be used horizontally in all pairs of conditions and only for goods that are not included in the provisions of the Regulation.

  • The current integration has been corrected, in some cases where only one condition pair existed (Y160 and import not allowed) and has been replaced by the insertion of new condition pairs. Some of the updated merchandise are:

    • 8430, 84310,8432, 84330, 84342, 8436, 8438 40, 8438 50, 8438 60, 8438 80 91 and 8428 90.

    • 3307 49 00 90, 3506 91 90 99, 3808 91 10 90, 3808 94 90 90, 3307 49 00 10, 3506 91 90 91, 3808 91 10 10 and 3808 94 90 10

  • For empty containers, a new condition pair has been added for the Y123/Y160 record.

  • The current measures for goods in categories 12, 13 and 14 of Annex IV of the RGF are modified, and two new measures are integrated for category 15 (codes 4011 and 4012).
