Acceptance of the authorisation application
Except for special rules, requests for decisions regarding the application of customs legislation will be accepted provided that the following conditions are met:
- That, when required by the regime to which the application relates, the applicant is registered in accordance with article 9 of the Code (EORI)
- That, when required by the regime to which the application relates, the applicant is established in the customs territory of the Union
- The application has been submitted to a customs authority designated to receive applications in the Member State of the competent customs authority referred to in Article 22,1, third paragraph, of the UCC
- That the application does not refer to a decision for the same purpose as a previous decision addressed to the same applicant, which has been revoked or cancelled during the period of one year preceding the request, as the applicant has not fulfilled the obligations imposed by that decision
The period will be extended to three years when:
- The previous decision was cancelled in accordance with Article 27. 1 UCC
- This is an AEO request
