IX.5.9. Treatment of rejected TIR transports

Explanatory note to Article 2 (0.2-1)

TIR transport may begin and end in the same country provided that part of the journey takes place in the territory of another Contracting Party.

This principle also applies when another Contracting Party does not allow TIR transport to continue through its territory (for example, due to a ban on certain goods). In such cases, there are two alternative scenarios:

  • The customs office of entry of the Contracting Party concerned must initiate the TIR operation and immediately certify its completion, indicating the specific reason for its rejection in the "Reserved for Administration" box on all remaining sheets. The TIR Carnet holder will then return to the customs office of exit of the preceding country and request a change in the country and customs office of destination for the TIR transport. To this end, the TIR Carnet holder shall request the customs authorities to certify the changes made in box 7 on page 1 of the cover sheet and in boxes 6 and 12 on all remaining pages.
  • The customs office of entry of the Contracting Party concerned refuses to certify the TIR Carnet in the manner described above. The TIR Carnet holder will then return to the customs office of exit of the preceding country and request a change in the country and customs office of destination for the TIR transport. To this end, the TIR Carnet holder shall request the customs authorities to certify the changes made in box 7 on page 1 of the cover and in boxes 6 and 12 of the remaining sheets of the TIR Carnet and shall also request that they include in the "Reserved for administration" box on all the remaining sheets a reference to the non-acceptance of the TIR Carnet by the authorities of the successor country.

The same TIR Carnet (the remaining pages) can be used to continue the TIR transport.
