VII.2.3. Effects of the termination

The fact that the transit procedure has been terminated, whether implicitly or formally, shall not affect the rights and obligations of the competent authority with regard to the imposition of penalties on the holder of the procedure or the guarantor if, at a later date, it is established (in accordance with the statutory time limits for the recovery or imposition of penalties) that the procedure has not, in fact, been terminated and should therefore not have been terminated, or if, at a later stage, irregularities relating to specific transit procedures are identified.
